Please read these Terms & Conditions carefully and in their entirety before using www.TheButterflyWithin.me (hereinafter referred to as the “Site”). The Site and its content are owned by The Butterfly Within, LLC (also known as The Butterfly Within®). For the purposes of the Terms and Conditions, The Butterfly Within, LLC will be used.
PURPOSE: These Terms & Conditions are here to clearly explain, outline, and lay out the terms and conditions governing your use of this Site and any services, programs, or products offered by The Butterfly Within, LLC.
IMPORTANT NOTES:
By using the Site in any capacity, you voluntarily agree to these Terms & Conditions. You agree that you have read, understood, and consented to these Terms & Conditions. If you have any questions, please contact us through our Contact Request Form at www.thebutterflywithin.me/connect.
You must be at least 18 years old and be able to consent to these Terms & Conditions. If you are under the age of 18, or you do not agree with these Terms & Conditions as stated herein, please STOP now and do not use this Site or its content. By using the Site, you agree to the Terms & Conditions as stated herein, regardless of whether or not you have read these Terms & Conditions.
These Terms & Conditions contain an Arbitration Clause and require you to dispute or resolve any claim with us through Arbitration. By agreeing to these Terms & Conditions, you agree to the Arbitration Clause as outlined in Section 20 and voluntarily waive your right to a jury trial.
By proceeding on the Site, you hereby agree to the following:
1. Definitions:
“Company”, “We”, “I”, “Our”, or “Us” means The Butterfly Within, LLC (also known as The Butterfly Within®) and www.TheButterflyWithin.me. For the purposes of the Terms and Conditions, The Butterfly Within, LLC will be used.
“Content” means any and all written, visual, video, or audio information contained on the Site, including, but not limited to, any and all emails received from Lindsey Frank, The Butterfly Within, LLC, The Butterfly Within®, and/or www.TheButterflyWithin.me, and any and all written or downloadable material purchased, viewed, or otherwise offered by The Butterfly Within, LLC and/or on www.TheButterflyWithin.me, including, but not limited to, blog posts, graphics, newsletters, designs, documents, information, templates and materials. This includes, but is not limited to, proprietary frameworks, methodologies, language, and models created by The Butterfly Within, LLC, including the HEART-Centered Decision-Making Model, Guided Metamorphosis, and Butterfly Effect Catalysts™.
“Personal Information” means information that can be used on its own or in conjunction with other information to identify, contact, or locate a person, or to identify an individual in context. This may include, but is not limited to, your name, address, email address, telephone number, and any information you voluntarily provide through forms, surveys, intake or progress questionnaires, or other communications.
“Site, Courses, Services, and/or Products” means www.TheButterflyWithin.me, content (as defined herein), email list/newsletters, social media posts, blog posts, courses, coaching services, guides, books, eBooks, forms, worksheets, workbooks, workshops, retreats, webinars, website materials, heart-centered energy healing services, Guided Metamorphosis, wellness experiences, keynotes, resource videos, and/or templates and downloads available on the Site.
“Site” means www.TheButterflyWithin.me and any and all of its associated pages, tabs, landing pages, forms, or sub-pages.
“You” or “Your” means the user, customer, or viewer of the Site.
2. Consent:
By using the Site and/or making any Purchase, you implicitly and voluntarily agree to act in accordance with, and abide by, these Terms & Conditions, our Privacy Policy, and Disclaimer.
By using the Site and/or making any Purchase, you represent and warrant that you are at least 18 years-old. Any use of, or access to, the Site and its Content by anyone under the age of 18 is unauthorized and in direct violation of these Terms & Conditions, Privacy Policy, and Disclaimer.
3. Site Rules:
By using the Site and/or making any Purchase, you agree to use this Site and any associated services respectfully and lawfully. You agree not to:
Abuse, harass, or harm any person through or on the Site or within any associated services or experiences.
Post or transmit obscene, offensive, libelous, defamatory, pornographic, or abusive content, or content that infringes upon our intellectual property rights or those of another person, website, or company.
Use the Site or any related services in any way that violates any applicable laws or regulations.
Post or transmit any “spam” or unsolicited communications.
Share or distribute content that does not belong to you or that you do not have permission to use.
Promote or sell your own content, services, or products through the Site or within any programs, containers, or experiences without prior written consent.
Copy, reproduce, distribute, or share our intellectual property in any way that infringes upon our rights.
We reserve the right to remove any content, restrict access, or terminate participation in our Site, services, or experiences if these terms are violated.
4. DISCLAIMER:
By using this Site and engaging in any of our services, you acknowledge that The Butterfly Within, LLC provides coaching, transformational experiences, mindfulness practices, yoga, meditation, and heart-centered energy healing services. While these services may support personal growth, well-being, and self-awareness, they are not a substitute for licensed medical, psychological, psychiatric, or therapeutic care. Our Content is for informational and educational purposes only, and is based on our personal experience. Our Content is not meant as a substitute for professional advice.
We do not diagnose, treat, prevent, or cure any physical or mental health condition. You are solely responsible for consulting with a qualified healthcare provider regarding any medical or mental health concerns. Participation in any of our services including coaching, energy healing, yoga, meditation, workshops, or retreats is voluntary and at your own discretion.
You acknowledge that results are not guaranteed, experiences may vary from person to person, and transformation is dependent on your own engagement, readiness, and personal circumstances.
5. In-Person Services and Location Disclaimer
For services conducted in person, whether at a private residence, rented space, or third-party location, you acknowledge that you are voluntarily participating in the environment in which services are held. You agree to take full responsibility for your own safety, well-being, and personal belongings during any in-person experience.
The Butterfly Within, LLC is not responsible for any injuries, loss, or damages that may occur in connection with your presence at a physical location, to the fullest extent permitted by law.
When services are held at third-party locations, you also agree to abide by any rules, policies, or guidelines set forth by that venue.
We reserve the right to refuse or remove participation at our discretion for a violation of the terms and conditions.
6. No Professional-Client Relationship
Your use of this Site and participation in our services does not establish a therapist-client, medical-provider, or legal relationship. Any guidance provided is for educational and personal development purposes only.
7. Assumption of Risk
By participating in any services offered by The Butterfly Within, LLC—including but not limited to coaching, energy healing, yoga, meditation, workshops, and retreats—you acknowledge that such activities may involve emotional, mental, and/or physical experiences. You voluntarily assume all risks associated with your participation and agree that The Butterfly Within, LLC is not responsible for any injuries, distress, or outcomes that may arise from your participation.
8. Your Consent to These Terms & Conditions:
By using this Site, or Purchasing or Downloading from our Site, Courses, Services, and/or Products, you implicitly and voluntarily agree to these Terms & Conditions as stated herein.
9. Changes To These Terms & Conditions:
We reserve the right to change, amend, or otherwise alter these Terms & Conditions at any time without notice to you. When changes are made to these Terms & Conditions, we will update the “Updated on” date at the bottom of this page. If you do not agree with these Terms & Conditions, please do NOT use our Site, read or implement its Content, or Purchase or Download anything from us.
10. Links to Third-Party or External Websites:
The Site may contain or include website URL links to third-party or external websites. Typically, these URL links are provided so that you may directly access a site that contains relevant information. Please note we are not liable for any of the information contained on or within the third-party or external websites. We are not responsible for the way they handle your personal information, whether they have a privacy policy, or any information you provide to them by visiting their website. You are responsible for reading and agreeing to, or expressing disagreement with, the external website’s privacy policy or terms & conditions.
11. Intellectual Property Ownership:
The Site and its Content are intellectual property solely owned by The Butterfly Within, LLC. The Site and its Content are protected by United States copyright and trademark laws, as well as state intellectual property laws. Any violations of this term, and all terms contained herein, will be legally pursued to the fullest extent permitted by law.
12. Our Limited License to You:
If you view, access, or Purchase the Site, Courses, Services, and/or Products, you are considered our Limited Licensee (“Licensee”). As a Licensee, you agree and understand that the Site, Courses, Services, and/or Products have been written, created, drafted, invented, and developed by us after a significant investment of time, money, education, hard work, and brainpower. The Site, Courses, Services, and/or Products are extremely valuable to us, both professionally and personally, and we take the protection of our Site, Courses, Services, and/or Products very seriously.
You may not use the Site, Courses, Services, and/or Products in any manner that is unauthorized, improper, against these Terms & Conditions, or our Privacy Policy, or which violate U.S. intellectual property laws unless authorized by us in writing beforehand.
13. Your License to Us:
By commenting on the Site, or submitting documents to The Butterfly Within, LLC via contact form, email, or social media, you represent that you are the lawful owner of said documents, statements, and/or the information they contain. You grant us a license to use your comments or submissions in any way we see fit, as it relates to our business purposes.
14. Purchase & Access Terms:
During the course of your use, Purchase, and/or Download from the Site, Courses, Services, and/or Products, you agree and understand that you cannot distribute, copy, forward, and/or share information prohibited by these Terms & Conditions. You also agree and understand that you are to take all necessary steps to make sure that you do not inadvertently share or distribute said materials, including, but not limited to, protecting your password (if any) to the Site to access your Purchase or Download. Any violations of these Terms & Conditions will be legally pursued to the fullest extent permitted by law.
15. Sharing the Site & Its Content:
You must request and receive written permission by our Contact Request Form before sharing our Site and its Content for commercial purposes. You may share the site for personal purposes, but we ask that you link directly to the Site. You are required to give us and the Site credit by linking to the Site and its Content if you share it on social media or your own website, including all photographs. Since the Site and its Content are not yours, you may not in any way imply or represent that the Site or its Content are yours or that you in any way created, caused, or contributed to the Site or its Content. You may not make any claims that you are in any way associated with The Butterfly Within, LLC.
16. No Claims Made Regarding Results:
Any testimonials, examples, or client experiences shared are for illustrative purposes only. They reflect individual experiences and are not guarantees of results. Each person’s experience is unique, and outcomes will vary based on individual circumstances, participation, and readiness for change.
17. DISCLAIMER - No Warranties, Guarantees, or Representations:
We do not offer any warranties or guarantees of any kind, express or implied, regarding the Site, Courses, Services, and/or Products. All content, services, and products are provided “as is” and “as available,” without warranties of any kind, to the fullest extent permitted by law. To the fullest extent permitted by law, we make no representations regarding the accuracy, completeness, or reliability of any content or services provided.
18. Your Release of Us:
By using the Site or Purchasing, Downloading, or using The Butterfly Within, LLC’s Courses, Services, and Products, you agree to release, forgive, and forever discharge The Butterfly Within, LLC, its subsidiaries, employees, agents, contractors, subcontractors, and affiliates from any and all claims, suits, actions, charges, demands, liabilities, damages, judgments, and/or costs, whether known or unknown, both legal and equitable in any manner.
19. Errors & Omissions:
Every effort is made to provide up-to-date accurate information both on the Site and through our services. However, due to the complexity of the issues we cover, The Butterfly Within, LLC does not and cannot warrant, represent, or guarantee that such information is free from errors, accurate, or up-to-date at all times. You should do your due diligence, research, or consult with a professional to ensure that all information you receive, act upon, or rely on from this Site and/or from our services is accurate and up-to-date.
20. ARBITRATION CLAUSE:
If you have any complaints or should any issue arise in the use of the Site or The Butterfly Within, LLC’s Courses, Services, and/or Products, please contact us directly first by our Contact Request Form.
However, if we are unable to amicably resolve your dispute in that manner, you agree that you and The Butterfly Within, LLC shall submit your dispute to binding arbitration with the American Arbitration Association, before an arbitrator in accordance with the American Arbitration Association’s (“AAA”) rules.
By agreeing to this term, you hereby agree and understand that you’re waiving your right to a jury trial in court, which would otherwise be available to you if not for this Arbitration Clause. Should any arbitration hearing need to be held, it shall be held within 50 miles of Arlington Heights, Illinois, from which the arbitration hearing will be held.
If the arbitrator issues an award and a judgment is made, the judgment will be binding and will be entered in court in the State of Illinois. Any damages awarded shall be limited to the amount paid to The Butterfly Within, LLC for the applicable Product or Service. You are not permitted to seek additional damages, including consequential or punitive damages.
21. Consent to Governing Law:
These Terms & Conditions, and any dispute arising out of them, shall be governed by the laws of the State of Illinois.
22. Consent to Jurisdiction:
You hereby irrevocably consent to the exclusive jurisdiction and venue of any Federal Court in the United States District Court for the District of Illinois or a state court located within the State of Illinois in connection with any matter arising out of these Terms & Conditions, Privacy Policy, Disclaimer, or as a result of your use, Download, or Purchase from the Site, Courses, Services, and/or Products.
23. Consent to Service:
You hereby irrevocably agree that process may be served on you in any manner authorized by the Laws of the State of Illinois for such persons, and you waive any objection which you might otherwise have to service of process under the laws of the State of Illinois.
24. Payment & Purchases:
When you purchase or engage in any Courses, Services, or Products from The Butterfly Within, LLC, you may pay using approved payment methods, including credit card, PayPal, Zelle (or other approved electronic transfer methods), and, in certain cases, check or cash.
Checks are accepted for organizational, school, or business contracts and may be submitted by mail or as otherwise agreed upon in advance. Individual clients may also pay by check or cash for in-person services when arranged ahead of time.
All check and cash payments must be agreed upon in advance and are subject to approval at our discretion.
For purchases made using a credit card or an automated payment system, you authorize The Butterfly Within, LLC to charge your selected payment method for the agreed-upon amount at the time of purchase or according to any agreed payment schedule.
You will receive a receipt or confirmation of payment for your records.
Payment plans may be offered at our discretion and agreed upon in advance. In such cases, you agree to complete all payments according to the agreed-upon schedule, regardless of your level of participation in the service.
If you are provided with an invoice-based payment plan, you are responsible for submitting payments on time as outlined in your invoice or written agreement.
If you elect an installment or “pay over time” option through an automated checkout system, you authorize The Butterfly Within, LLC to charge your selected payment method for each installment on the agreed-upon dates without additional notice.
Failure to complete payments may result in suspension or termination of access to services and may be subject to collection efforts as permitted by law.
If your payment method fails or is otherwise declined, you will be removed from, or canceled from having access to, our Courses, Services, and Products. Please note, in the event your payment method is declined at any time, you are still responsible for the full cost of your Purchase.
You agree not to initiate chargebacks without first making a good-faith effort to resolve the issue with us directly. In the event of a chargeback, we reserve the right to provide these Terms & Conditions and proof of purchase to the financial institution. If any chargebacks are placed on a Purchase or Download of our Courses, Services, and Products, we reserve the right to pursue collection efforts as permitted by law. Doing so could have a negative impact on your credit report and/or credit score. Should we need to do so and you would like to have this report removed from your credit report, please contact us to arrange for payment owed. Once payment owed is received, we will make the appropriate reports to the credit agencies.
Payment processing companies may have different privacy policies and practices than we do. We are not responsible for the policies of the payment processing companies. As with any online purchase, there are circumstances beyond our control which may compromise your credit card or payment method. We are not liable or responsible for any of those circumstances.
You hereby release us from any and all damages related to your payment or use of our payment processing companies, in which you incur and further agree not to assert any claims against us or them for any damages which arise from your Purchase or use of our Site and its Content.
Payment is due in full at the time of booking unless otherwise agreed upon in writing.
For individual clients, services will not be confirmed or rendered until payment has been received.
For organizational, school, or business contracts, payment terms (including due dates) will be outlined in the individual agreement or invoice and may follow agreed-upon timelines.
Services may be withheld or rescheduled if payment is not received.
25. Our Refund Policy:
Due to the nature of our services and offerings, all sales are final unless otherwise stated in writing. By purchasing or engaging in any of our services, you acknowledge and agree to the following:
1:1 Services (Coaching, Energy Healing, Catalyst Sessions):
All sessions are non-refundable once scheduled or completed. If you are unable to attend, please refer to our Cancellation & Rescheduling Policy.
Transformational Coaching Packages:
Payment plans and package commitments are non-refundable. You are responsible for completing all agreed-upon payments regardless of your level of participation.
Digital Products, Downloads, and Courses:
All digital products are non-refundable once accessed, downloaded, or delivered.
Workshops, Group Experiences, and Guided Metamorphosis:
All registrations are non-refundable due to limited capacity and the nature of group experiences. If you are unable to attend, please refer to our Cancellation & Rescheduling Policy for transfer options, if available.
Retreats and In-Person Events:
Retreats and in-person events may have specific refund or cancellation terms outlined at the time of registration or within a separate agreement. Unless otherwise stated, payments are non-refundable.
Organizational Contracts (Schools, Businesses, Speaking Engagements):
Refunds and payment terms for contracted services are governed by the individual agreement or contract in place.
We encourage you to reach out with any questions prior to purchase so you can make a fully informed and aligned decision.
26. Cancellation & Rescheduling Policy
We understand that life transitions, unexpected events, and changing circumstances arise. At the same time, our work together is held within intentional, time-bound containers that require preparation, presence, and reserved space.
By engaging in any of our services, you agree to the following:
1:1 Sessions (Coaching, Energy Healing, Catalyst Sessions):
A minimum of 24 hours’ notice is required to cancel or reschedule a session.
Sessions canceled with less than 24 hours’ notice may be forfeited and are not guaranteed to be rescheduled.
No-shows or missed sessions without notice will be considered forfeited.
Rescheduling is offered at our discretion and based on availability.
Workshops, Group Experiences, and Guided Metamorphosis:
Due to limited capacity and the nature of group containers, all registrations are final unless otherwise stated.
If you are unable to attend, you may request to transfer your spot to a future offering (if available), but this is not guaranteed and is subject to approval.
For virtual experiences, access to recordings (if applicable) may be provided in place of attendance.
Retreats and In-Person Events:
Retreats and in-person events may have specific cancellation terms outlined at the time of registration or in a separate agreement.
Due to the logistical and financial commitments involved, refunds are generally not provided unless otherwise stated.
Organizational Contracts (Schools, Businesses, Speaking Engagements):
Cancellation and rescheduling terms for contracted services will be outlined in your individual agreement or contract.
In the absence of a separate agreement, a minimum of 7 days’ notice is requested for cancellations or rescheduling.
Our Right to Reschedule
We reserve the right to reschedule sessions or events due to illness, emergency, or circumstances beyond our control. In such cases, we will work with you to find a suitable alternative time. We approach all situations with care and integrity and may make exceptions in cases of genuine emergency at our discretion.
27. Limitation of Liability:
The Butterfly Within, LLC is not responsible or liable in any way for any and all damages you receive directly or indirectly from your use, Purchase, or Download from our Site, Courses, Services, and/or Products. We do not assume liability for damages, injuries, harm, death, misuse of (or failure to properly use) information or documents, due to any act, or failure to act, by you. To the fullest extent permitted by law, your sole remedy for any claim arising out of your use of our Site, Services, or Products shall be limited to the amount you paid for the applicable service or product. IN NO EVENT SHALL WE BE LIABLE TO YOU FOR ANY INDIRECT, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES.
28. Defense & Indemnification
You shall, at all times, indemnify, defend, and hold harmless The Butterfly Within, LLC, Lindsey Frank, and all of our shareholders, officers, members, affiliates, contractors, subcontractors, directors, assignees, employees, and licensees from and against all losses, damages, injuries, delays, deaths, lost profits, and expenses arising out of any proceeding (a) brought by either a third-party or by The Butterfly Within, LLC and Lindsey Frank (b) arising out of your breach of your obligations, representations, warranties, or covenants under these Terms & Conditions, or the Privacy Policy; and (c) arising out of any alleged breach or negligence said to have been committed by us.
29. Force Majeure
We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, illness, travel disruptions, government actions, or other unforeseen events.
30. Termination of Your Use
At our sole discretion, we are permitted to terminate your use or access to the Site, Courses, Services, and/or Products, and Purchases/Downloads if you abuse, violate, or breach any of these Terms & Conditions, Privacy Policy, Disclaimer, or any other terms to which you have agreed to.
31. Entire Agreement
These Terms & Conditions, our Privacy Policy and Disclaimer, constitute the entire agreement between you and us with respect to the Site, Courses, Services, and/or Products, and they supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and us with respect to the Site, Courses, Services, and/or Products.
32. Severability
The provisions of these Terms & Conditions are severable, and the invalidity or unenforceability of any provision shall not affect the validity and enforceability of any other provision herein. If any paragraph, section, subsection, sentence, or clause of these Terms & Conditions are rendered illegal, invalid, or unenforceable, such illegality, invalidity, or unenforceability shall have no effect on these Terms & Conditions as a whole or on any other paragraph, section, subsection, sentence, or clause herein.
